This website and the SMS location service called Geotec (hereinafter the Service) is available to any user, for their own consumption, and subject to the following terms and conditions: these Terms of Use and Contracting (hereinafter TUC), Our Privacy Policy and Cookies Policy.
When you use the Service, you accept these TUC and the rest of the terms and conditions.

With this you agree not to use this site for illegal purposes.

3. Service description

Through this Service, Geotec allows you to locate the current position of a person who explicitly consents to being located. The Service allows you to send an SMS to the recipient to indicate that someone wants to know their location. If the recipient of the message expressly accepts, the recipient's position at that particular moment is shared to the person requesting the service. In no case does Geolocation continue to share your location beyond the specific moment in which it has been accepted.

The montly payment of the service does not guarantee that the person sought can be located, it only provides the means to achieve this end. If the person is missing, has had their mobile phone stolen, turned off or does not accept the link we send in the SMS, etc., we will not be able to get their GPS position.

In this way, the customer acknowledges that they understand and agree to payment even though there is a possibility of not receiving the service, as a result of the circumstances mentioned above.

4. External links

You may be sent to other websites through links from the service. However, Geotec does not control those sites or their content, which are in fact subject to their own terms and conditions. Therefore, Geotec is NOT responsible for the quality, truthfulness or accuracy of those sites.

5. Age

Regarding the use of the Service, you declare that you are of legal age and that you have the necessary legal capacity to be bound by this agreement and use it in accordance with its terms and conditions, which you fully understand and recognise.
You declare that all the information you provide to access the Service, before and during its use, is true, complete and accurate.

6. Intellectual and industrial property.

The content and information of the Service (among other data, texts, sounds, images or computer code), as well as the infrastructure used to provide such content and information, is the property of Geotec or has the corresponding authorisations for its use. In addition, the modification, reproduction, duplication, copy, distribution, sale, resale and other forms of use for commercial or equivalent purposes of the Service are prohibited.

For any other use of the Service content you need our prior written consent.

7. User Content

You can contribute to the Service by sending us messages to our email address at info@ludicobusiness.com (hereinafter “Content”). We may use your Content in different ways, such as: displaying it on the website, reformatting it, translating it into other languages, editing it for clarity, correcting errors, promoting or distributing it.

Therefore, by sending us Content you grant Geotec a worldwide, non-exclusive, free - until the content is withdrawn - transferable and sub-licensable licence with regard to said Content.

This means that the content is still yours, but thanks to that licence, Geotec can: a) use, reproduce, modify, adapt, translate, distribute and publish the Content, create derivative works from it, show and display it throughout the world, by any known means and for any legitimate purpose; and b) use the name you submit in relation to that Content.

However, Geotec reserves the right not to publish any content or information that is false, illegal, misleading or contrary to the rights of third parties.

8. Price and taxes

The prices of the plans offered by Geotec are indicated in euros (€) and include the value added tax (VAT) applicable to these services in Spain.
In the event that the place of residence or domicile of the customer is another European Union member state or a third state, the price of the plan may be modified if the applicable tax rate is different.

9. Payment methods

The payment of the contracted Service may be made:
- By VISA or MasterCard credit or debit card, the amount being charged at the time of purchase of the products.

In this regard, Geotec informs the holders of credit and debit cards that it is responsible for transactions made on the online store. They are made on a secure page, using SSL technology to ensure the security of data transmission.

10. Validity of offers

The Service offered, and the prices of its possible plans or modalities, will be available for purchase as long as they are accessible through this website.
In any case, Geotec reserves the right to make the modifications it deems appropriate to the Service, being able to update products and services depending on the market.

Regarding the prices that appear on the website, Geotec reserves the right to change them without prior notice.

We inform you that despite updates made to the prices of Service, they may contain mistakes. We will promptly correct all errors that appear, but these will not be binding for the Service.

11. Guarantees

All rights that current laws provide for you as a consumer and user are guaranteed.
In any case, although Geotec will make all reasonable commercial efforts to provide the Service, you understand that: a) the Geolocation of the user requires the express consent of the recipient and; b) that even with your consent, the current state of technology cannot guarantee that their location is always obtained or that location can be performed with sufficient accuracy.

In any case, and to the extent permitted by law, Geotec reserves the right to refuse, suspend or cancel the provision of the Service at its sole discretion.

12. Liability

To use the Service you confirm that: a) you have obtained the telephone number you intend to locate in a lawful manner and with the prior consent of its owner and; b) that you do not intend to use the Service for any illegal purpose. On the other hand, to the extent permitted by applicable law, Geotec will not be responsible for the eventual loss of data or programs derived from the use of the Service.

13. Security

On the other hand, Geotec guarantees the security of the Service in accordance with present technological knowledge.
However, Geotec cannot guarantee the total security of the Service, although it undertakes to repair this and implement the appropriate corrective measures to rectify any eventual security failure as soon as possible.

The user agrees to notify the Service, immediately and via email to info@ludicobusiness.com, of any loss of information, access or unauthorised use by third parties or any situation that could lead to the impersonation of the Identity of other users.

Geotec will not be liable for the damage that may arise from the use of the Service if it originates from unpredictable technical problems or which, if foreseeable, are unavoidable. Similarly, Geotec will not be liable when the user's misuse, whether the sender or receiver of the message, causes the damage.

14. Subscription and refund

You access the service with a payment of € 0.60 for 48 hours (trial version) and then a monthly subscription of € 39.99 for an indefinite period and unless you cancel your subscription, you authorise us to charge the corresponding montly subscription fee through your payment method. You can cancel your subscription to the Service whenever you want, and you will continue to have access to it until the end of your montly billing period. To the extent permitted by law, payments are non-refundable and we do not provide refunds or payments for partial monthly subscription periods.

If the credit card with which you signed up for the service does not have funds at the time of making the monthly payment, the account will be canceled at that moment

The subscription entitles you to an unlimited service of location, although in the event that services cannot be performed for external reasons as already mentioned (if the person is missing, has had their mobile phone stolen, if the mobile phone is off, they do not accept the link we send in the SMS, or there is a lack of coverage, etc.) you will not be entitled to a refund

15. Compensation

If you contract the Service, you will be contracting the provision of digital content not provided physically.
Therefore, and from the moment at which the content has begun to be performed, you accept and understand that the right of withdrawal is not applicable to such contracting as established in art. 103 m) of the General Law for the Protection of Consumers and Users, text approved by Royal Legislative Decree 1/2007 of 16 November.

16. Modifications and nullity

We may update the terms and conditions of the Service in the future, as well as features and functions of the Service itself. We will inform you about changes in terms and conditions by placing a notice in a prominent place on our website and/or by email.

If any clause included in our terms and conditions is declared, totally or partially, null or ineffective, it will only affect said provision or the part of it which is null or ineffective. Our terms and conditions shall continue in all other respects, and such provision, or the part thereof, which may be affected shall be deemed to have not been made.

17. Claims and actions derived from the contract

This service is governed by Spanish legislation. In order to simplify the resolution of claims through civil law and reduce costs, we do not rule out the possibility of submitting to an Arbitration in Law before the Arbitration Court of the Chambers of Commerce and Industry.

In this sense, and according to the applicable regulations, Geotec informs you of the existence of a European online dispute resolution platform that facilitates the extrajudicial resolution of said litigation for contracts concluded online between consumers and Internet service providers.
