CONTRACTING TERMS AND CONDITIONS

This section establishes the contracting and acquisition of the products through the site www.locate-mobiles.net (hereinafter the Website), owned by LUDICO BUSINESS & ENTERTAINMENT, S.L. (hereinafter the Manager).

By accepting this contract, the consumer and/or user (hereinafter customer) accepts the following:

1.- That they are a person with sufficient capacity to contract the services.

2.- That they have read, understood and accepted without reservation each of the points of these terms and conditions.

3.- That they assume all established obligations.

The Manager is not intended to process data corresponding to minors. The Manager only sells to persons of legal age according to Spanish legislation (article 315 of the Civil Code).

These conditions will have an indefinite period of validity and will be applicable to all contracts made through the Manager of www.locate-mobiles.net

The Manager reserves the right to modify the contractual offer constituted by these terms and conditions and the list of products and their prices, at any time, although these modifications will not be made to the contracts already concluded by the consumer and/or user. Therefore, it is recommend to read this before proceeding with the purchase of any product/service offered.

On the other hand, the customer, whose purpose is to be a consumer and/or user of the same and/or to contract the Website's products or services.

The communications made between the customer and the Manager by such means will be considered effective and valid for all purposes.

CUSTOMER RESPONSIBILITY

The customer is obliged to make lawful use of the Manager and the services provided therein, respecting the current legislation and refraining from damaging the rights and interests of third parties and the the Manager.

The customer is responsible for the veracity of the data that they provide to the Website, and therefore they will be liable for consequences that may arise as a result of providing false or erroneous data on this website.

The customer must respect and accept the contracting terms and conditions, and the legal and privacy notices established on this website.

Failure to comply with the foregoing may result in the withdrawal or cancellation of services by the Manager without prior notice and without the right to compensation, as well as the initiation of legal action to which the latter is entitled resort to.

LIABILITY:

The Manager undertakes to respect the obligations established in these contracting terms and conditions.

The language in which the relationship with the customer is carried out will be Spanish.

CONTRACT PURPOSE (DESCRIPTION OF THE SERVICES).

The purpose of this contract is to regulate the relationship between the Manager and the customer at the moment in which they give their consent during the contracting process by accepting the corresponding box. (A box that, prior to acceptance, will inform the user of these terms and conditions, and the legal notice and privacy policy of this website).

The contractual relationship of service provision will entail the delivery of one or more services contracted in exchange for a specific price, in order to both offer information about the services provided and to allow for the acquisition of said services through the portal.

CONTRACTING PROCESS

The online contracting of the services on the Website can be carried out according to what is established in these contracting terms and conditions, with prior REGISTRATION on the site being required. The User will have access credentials for this. The User undertakes, in general, to use the Website in accordance with the provisions of its terms and conditions and not to carry out any actions contrary to the law, to moral values or to public order. Likewise , they undertake not to carry out actions that could prevent, damage or deteriorate the normal functioning of the services or that could injure or cause damage to the property and rights of www.locate-mobiles.net, its suppliers and to users in general.

SERVICES OFFERED.

The services included in the shop will correspond as faithfully as possible to the services offered. The prices indicated are in euros and include VAT, unless otherwise indicated. The prices will be governed by our current rate , except in the case of typographical errors, with LUDICO BUSINESS & ENTERTAINMENT, S.L. reserving the right to modify them without prior notice. LUDICO BUSINESS & ENTERTAINMENT, S.L. undertakes not to allow any transaction that is illegal, or is considered fraudulent and reserves the right to cancel or refuse any User-Customer service with whom it maintains a dispute regarding the payment of a previous service.

The services performed online through www.locate-mobiles.net entail contractual data between the User-Customer and the shop which will be subject to confirmation and collection by both parties. The User-Customer declares that they know and accept these terms and conditions of sale. Unless proven otherwise, the data recorded by the shop constitutes proof of the set of transactions made between LUDICO BUSINESS & ENTERTAINMENT, S.L. and its customers.

The services provided are as follows: location of the mobile phone in case of loss, this location will allow the user to easily find the location of the device.

SERVICES' PRICE AND TERM OF VALIDITY.

The price of each service is reflected in the current catalogue and on our website: www.locate-mobiles.net

The customer accepts that the economic valuation of some of the services may vary in real time . As a consequence, the price to be applied will be that which is in force on the date of the service's provision. However, said final price will have been previously communicated to the customer during the electronic purchase process and before they proceed to finalise their acceptance of the purchase.

The prices indicated for each service include Value Added Tax (VAT) and will always be expressed in Euros (€).

The customer can check and calculate the total price of the service with exact breakdowns before proceeding to finalise payment through the purchase process enabled on the website.

PAYMENT METHOD

The Manager uses information security technology which is generally accepted in the industry, such as firewalls, access control procedures and cryptographic mechanisms, all in order to prevent unauthorised access to data. To achieve this, the user/customer accepts that the provider obtains data for the purpose of achieving the corresponding access control authentication.

Any contracting process or other process which entails the introduction of personal data (name, bank details, addresses), will always be transmitted through secure communication protocol (HTTPS://), so that no third party may have access to the information transmitted electronically.

1) By credit card. Through this means of payment, the customer must provide their card number, expiration date and CVV number. In this case, their data will be encrypted and sent via secure server to the virtual POS of the bank. This procedure does not provide the card number to the Manager.

RIGHTOFWITHDRAWAL

It is expressly noted that the consumer will have to pay shipping costs for the return of goods when exercising their right of withdrawal.

Article 103 of the TRLDCU (General Law for the Protection of Consumers and Users) establishes the exceptions to the consumer's right of withdrawal:

a) The delivery of services, once the service has been fully executed, when the performance has begun, with the express prior consent of consumers and users and with acknowledgement on their part that they are aware that, once the contract has been fully implemented by the company, they will have lost their right of withdrawal.

b) The supply of goods or provision of services whose price depends on fluctuations in the financial market that the company cannot control and which may occur during the withdrawal period.

c) The supply of goods made to the consumer’s specifications or which are clearly personalised.

d) The supply of goods which are liable to rapidly deteriorate or expire.

e) The supply of sealed goods which are not suitable to be returned due to health and safety or hygiene reasons after they have been opened following delivery.

f) The supply of goods which after delivery and given their nature have been mixed inseparably with other goods.

g) The supply of alcoholic beverages, the price of which has been agreed upon at the time of the conclusion of the sales contract, the delivery of which can only take place after 30 days and the actual value of which is dependent on fluctuations in the market which cannot be controlled by the business owner.

h) Contracts in which a consumer and the employer has specifically requested that the business owner visit them to undertake urgent repairs or maintenance; if, on that visit, the business owner provides additional services specifically requested by the consumer or goods other than replacement parts necessarily used in performing the maintenance or repair, the right of withdrawal should apply to those additional services or goods.

i) The supply of sealed audio or video recordings or sealed computer software which were unsealed by the consumer and user after delivery.

j) The supply of a newspaper, periodical or magazine with the exception of subscription contracts for the supply of such publications.

k) Contracts concluded at a public auction.

l) The provision of accommodation other than for residential purposes, transport of goods, car rental services, catering or services related to leisure activities if the contract provides for a specific date or period of performance.

m) The provision of digital content which is not supplied on a physical medium, when the performance has begun with the express prior consent of the consumer and user with knowledge on their part that they will consequently lose their right of withdrawal.

Withdrawal and Procedure:

To exercise their right of withdrawal, the consumer and/or user has a period of 14 calendar days from the reception of the service. To do so, the user must fill in the form provided for this purpose in the "customer service" section.

Regardless of means employed, their communication must contain the following information:

- Their identifying information: full name and address

- The service number which appears on the invoice which was sent to them along with the purchased goods

- Description of the goods acquired

- Their desire to withdraw from the service provision contract

- The bank account into which they want the price and fees to be refunded

- The date of communication

APPLICABLEGUARANTEES

The contractual guarantee offered is that established in Royal Legislative Decree 1/2007 of 16 November, which approves the consolidated text of the General Law for the Protection of Consumers and Users. The Manager will respond to breaches of conformity which manifest within two years of delivery and as long as the customer has informed the manager of said lack of conformity within two months of becoming aware of it. In case of defective service, the seller will proceed, as appropriate, to repair, replacement, price reduction or termination of the contract.

FORCE MAJEURE

Neither of the contracting parties will be liable for any fault caused by force majeure or the breach of these conditions due to unforeseen or external circumstances, such as acts of God, war, terrorism, embargoes, the actions of civil or military authorities, fire, floods, accidents, strikes, or lack of transport facilities, of fuel, of energy, of labour or of materials. The termination of the contract will be postponed until the force majeure situation comes to an end.

COMPLAINT FORMS

Complaint forms are made available to the consumer/user from the address CALLE O´DONNELL 16 28009 MADRID, SPAIN, as established by the regulations on this matter. Notwithstanding the foregoing, the consumer and/or user may, in any case, request the delivery of said form through the contact form provided for this purpose in the section "customer service" or from the email address info@ludicobusiness.com.

JURISDICTION AND APPLICABLE LAW

The parties submit themselves, at their own will, to resolve conflicts before the judges and courts of the city of the user's domicile, thereby renouncing any other jurisdiction.
